Axsome settles all SUNOSI patent litigation; generic entry deferred to 2040

Axsome Therapeutics, Inc.

• Resolved all outstanding SUNOSI patent litigation with the last first-to-file generic applicant.
• Settlement grants five companies right to sell generic SUNOSI starting September 1, 2040 (if pediatric exclusivity) or March 1, 2040.
• No other patent litigation remains for SUNOSI.
• Settlement will be submitted to FTC and DOJ for review as required by law.
